TERMS & CONDITIONS

1. Definitions

These Terms & Conditions (the “Booking Terms”) constitute an agreement between Locas Only and all persons intending to travel on a Locas Only booking (together referred to as “Client”, or “Passenger”), in respect of liability and responsibility provisions, so we kindly ask you to please take the time to read these carefully.
 

2. Our role as your Travel Agent

Locas Only extends its services to you, offering booking and advisory assistance concerning travel, accommodations, and various recreational activities (referred to as "Booking Services"). It's crucial to emphasize that Locas Only does not directly deliver any of the travel, accommodation, activities, services, products, meals, facilities, goods, or travel-related services linked to your holiday or listed on its website (referred to as "Travel Services").
 

Locas Only collaborates with external third-party entities, which include but are not limited to airlines, coaches, land operators, hotels, bus companies, tour operators, tour guides, meal facilitators andd other providers of services or products associated with Travel Services (collectively referred to as "Suppliers") in order to organize the trips clients purchase. When selecting these independent suppliers, Locas Only is meticulous, giving careful consideration to their reputation and reliability. It is essential to note, however, that Locas Only does not have direct oversight over these independent suppliers and, therefore, cannot be held accountable for their performance or any shortcomings thereof.
 

Therefore, we are not held responsible for any breaches in the Supplier's obligations regarding the provision of Travel Services. In situations where, for any reason (excluding our negligence), a Supplier is unable to provide the Travel Services you've acquired, your recourse lies with the Supplier and not with Locas Only. This encompasses scenarios where Travel Services cannot be delivered, adjustments to the itinerary are necessary, or any other inconvenience, delay, cancellation, or disruption occurs due to any unforeseen events or Force Majeure.
 

Our commitment to you is focused solely on the Booking Services, and our responsibility to you is strictly confined to these Booking Services. We serve as your agent when delivering the Booking Services to secure Travel Services from the Suppliers. It's important to note that the Travel Services listed on our website are not provided by us; they are offered by the Suppliers. Therefore, our liability to you is solely determined by these Terms & Conditions. 


Your Obligations & Acknowledgements as a Client

Client acknowledges that Locas Only has recommended reviewing these Terms and Conditions on the Locas Only website trip page before making a booking.


Client acknowledges the potential need to sign additional documents, including Medical Questionnaires, Waivers of Rights, and additional terms and conditions, as requested by the trip supplier to participate in a trip.
 

Client is responsible for adhering to all customs, rules, and procedures of the trip suppliers. Failure to comply with these customs, rules, and procedures may result in the client being denied continued participation in the trip. No credit or refund will be provided in such circumstances.
 

Client acknowledges that for all trips, they must purchase medical travel insurance, evacuation, and repatriation coverage, including personal injury and all forms of medical expenses.
 

Furthermore, clients are strongly advised by Locas Only to consider purchasing travel insurance covering trip cancellation (including COVID-19), trip interruption (including COVID-19), and property protection.
 

Clients are responsible for ensuring they possess all necessary travel documentation, including a passport (valid until at least 6 months after the expected return date), visas, parental consents for minors, and any required pardons related to criminal convictions for the destinations they are traveling to or through.
 

Clients should be aware that entry into another country may be denied, even with the required documentation, and Locas Only is not responsible for such occurrences.

Client acknowledges that the destinations they are traveling to may have different living standards, practices, and conditions regarding the provision of utilities, services, and accommodations compared to those at home.
 

When making a booking, clients must inform Locas Only of any special requirements related to travel arrangements, such as accommodation preferences and dietary restrictions. While Locas Only will convey these requests to trip suppliers, clients are responsible for any additional costs associated with them, and any failure by the trip suppliers to fulfill these requests is not Locas Only responsibility.
 

Client acknowledges that many trips are conducted far from medical care providers and may not be suitable for the client based on physical or mental requirements for participation. The client is responsible for assessing whether a trip is suitable for them and consulting a medical professional to confirm fitness for travel and trip participation.
 

Locas Only shall not be held responsible for any damage or loss experienced by clients due to non-compliance with the obligations outlined in this section of the Terms and Conditions


 

RESERVATIONS, PRICING AND PAYMENTS

 

The published prices of the Travel Offer includes all applicable taxes, charges and service fees, including GST (where applicable). 
 

Trip rates are determined on the premise of shared accommodation. Solo travelers will be paired with a roommate by Locas Only at no additional cost for a single supplement fee.

 

Payments will be made through the “WeTravel” Platform, for which Locas Only will assume the 1% processing fee. However, it is the Client’s responsibility to pay the fee associated with their credit or debit card transaction which is 2.9% of the total cost of the trip. 
 

All prices of our published Locas Only Adventures are listed in American Dollars (USD) unless stated otherwise. Locas Only disclaims responsibility for any charges resulting from currency exchange or fees levied by your credit card provider or bank for handling transactions in different currencies.
 

Travelers must make an initial deposit of 30% of the total quoted amount, which will be paid as a way to confirm the reservation. Locas Only will use this deposit to ensure the availability of the quoted services. The remaining 70% will be divided into 3 installments, as follows:

100% of the trip price must be paid 45 days before the arrival of the passengers. In the event of not receiving payments in a timely manner according to this contract, Locas Only is fully authorized to release the blocked contracted rooms and reserves the right not to provide the services mentioned in the Itinerary.

 

REGISTRATION AND PAYMENT METHOD:

The registration of participants for the trip, as well as the payment of all installments, will be carried out through the WeTravel platform, which will be available on the Locas Only website. For the collections from travelers, the platform usage fees (1%) will be covered by Locas Only. Credit card charges will be covered by each passenger.

 

DEADLINES FOR PROVIDING INFORMATION:

Failure to meet the deadlines may result in contracted services being subject to availability.


 

CHANGES AND REPROGRAMMING:

Changes to the itinerary due to force majeure:

 

Locas Only will not be responsible for the additional expenses or costs that may arise due to changes in the itinerary caused by force majeure, such as social and/or political disturbances, strikes, road blockades, weather, changes/cancellations in flight schedules, unexpected passenger discomfort, and, in general, any extraordinary phenomenon beyond the control of Locas Only.

 

In such circumstances, Locas Only may assist in managing a solution and will make its best effort to offer the client alternative solutions, reschedule services, and propose experiences of equivalent quality. However, if it is not possible or the client does not wish to accept the proposed alternatives, Locas Only is not obligated to refund the amount paid by passengers for activities and services not performed.

 

Changes or cancellations due to minimum numbers not met:

The minimum number of passengers required for the trip to take place is 8 people. If the minimum of 8 participants is not reached, Locas Only will refund the money paid to passengers up to that point, which has not been used to make payments to suppliers and cannot be recovered. Refunds to passengers are not immediate and may take the time that suppliers take to process refunds to Locas Only, respectively.

 

CANCELLATION AND REFUNDS:

If the client decides to cancel their trip, the following policies will apply depending on the cancellation date and the trip's start date:

 

Cancellations up to 45 days before the departure date:

  • The initial deposit is non-refundable. This deposit covers non-refundable costs of the trip such as flights, Inca Trail permits, etc.

  • Other payments made up to the cancellation date will be refunded.

Cancellations within 45 days before the trip date:

  • The initial deposit is non-refundable.

  • Of the other payments made up to the date, a 10% administrative fee of the total price will be charged by Locas Only.

  • Payments beyond the initial deposit and the administrative fee will only be refunded depending on the flexibility offered by the suppliers. We will make a good-faith effort to recover the most possible and refund it to passengers, but we cannot offer any specific guarantee. Airlines tend to have stricter refund policies, and we cannot guarantee any refunds or credits.

 

FLIGHTS:

Most national and international airline tickets are non-refundable, but it depends on the type of fare and conditions imposed by the airline. If the client requests a modification, cancellation, change of date, or route change, the client will be solely responsible for paying any penalties imposed by the contracted airline.

 

It is the client's responsibility to arrive at the airport on time for their flights. If the client misses any of their flights while at the airport, Locas Only cannot be held responsible for such financial loss.

 

Locas Only will not be responsible for any additional expenses or costs that may arise due to flight cancellations or schedule changes made by the airline, as this is beyond the control of Locas Only.

 

NO SHOW:

Under no circumstances will Locas Only be obligated to refund the passenger any amount related to activities or services that were not voluntarily used or due to the passengers' fault, such as lateness, for example.

 

HEALTH CONDITIONS

It is the client's responsibility to communicate in advance to Locas Only if they have any allergies, intolerances, dietary restrictions, or medical conditions that may pose a risk during the trip. All customers are required to have the necessary fitness, including physical, medical, or any other relevant criteria, to ensure they are fit for travel. It is your responsibility to be informed about any specific health requirements for your chosen travel destinations before making a reservation and to ensure that any relevant needs can be accommodated during your journey.

 

Locas Only recommends that clients check with a medical professional before booking a trip to make sure that they are capable of taking a specific trip. Locas Only also recommends that the client refers to the Locas Only website trip page to know more details about the trip and assess their physical and mental capability.

 

Locas Only ensures that its clients are taken to restaurants where services are of the highest quality, both in terms of service and food care and preparation. However, Locas Only is not responsible for adverse reactions or discomfort that the client may experience as a result of food consumption, especially in the case of allergies, sensitivities, or other pre-existing conditions.

 

Locas Only will also not be responsible for accidents and/or adverse situations that may arise during activities or services.

 

INSURANCE

The client is solely responsible for the custody of their luggage and documentation. Locas Only will not be responsible for the loss, theft, and/or damage of the client's luggage and/or documentation. Therefore, it is mandatory for passengers to have international travel insurance that covers medical services, evacuation, and repatriation. Although not compulsory, it is highly recommended that the insurance covers cancellations, interruptions, baggage, and personal belongings.


 

VISAS AND ENTRY REQUIREMENTS

It is the client's obligation to have a valid passport with at least six (6) months of validity counted from the return date of the trip and at least three (3) blank pages for visas, entry and exit stamps, etc. It is the client's responsibility to stay up-to-date with their visas, health documents, vaccines, and insurance required for entry into Peru and any other countries in which the client has a layover.

 

Locas Only will not be responsible under any circumstances for any failures or non-compliance that the client may incur in obtaining documents or any other entry requirements to Peru in accordance with current regulations. Likewise, if the client does not have the required permits and, as a result, cannot travel, they will be considered a No-Show.

 

Locas Only recommends that the client checks their government travel advisories for destinations and other locations on route to the destination.

 

Any information provided by Locas Only regarding visas, vaccines, weather, recommended clothing, etc., will be given in good faith but without any responsibility on the part of the company.

 

CLAIMS

Locas Only will be responsible for addressing and responding to complaints or claims from passengers only when they are related to a failure to comply with a service directly handled by Locas Only.

 

Locas Only will not be responsible for addressing or responding to complaints or claims if they correspond to hotels, restaurants, Inca Trail service, or other experiences in which Locas Only only acts as a travel agent.

 

Locas Only will not be responsible for any type of event caused by the misconduct of passengers, lack of punctuality, or any other action that may affect the proper conduct of the trip.
